WASECA — Waseca County District Judge Larry Collins has denied a motion to dismiss 12 of the 30 charges brought against a Waseca man accused last year of rape.
Armando DeLaCruz Jr. was accused of breaking into a Waseca woman's house, threatening her and raping her, according to the criminal complaint. The woman eventually escaped and police later arrested DeLaCruz.
DeLaCruz was charged with 29 felonies and one misdemeanor crime. His defense attorny argued the state was excessively charging him for one alleged incident. The Waseca County attorney argued the defense was misrepresenting prior Minnesota rulings, and that the alleged attack represented at least three incidents of rape.
Collins denied the motion Jan. 2, ruling that the court was unable to find reasonable evidence that the state is unable to charge the defendant with multiple counts of criminal sexual conduct.
